We expect this initial Privacy Policy of Sunflower Labs Inc. to apply during our initial stage while we market our products and collect reservations for the Sunflower system, and prior to selling these products.
Collecting Information
During this initial phase, we will collect very limited information you provide to us when you place a reservation; specifically, we will obtain your name, email address and desired country for shipping the products. The information you provide is up to you. It is your responsibility to ensure that your information is correct, and we may rely upon that information being current in order to contact you to complete your purchase. When you provide your credit card to secure your reservation, that information will be entered into the systems of third parties we are using to manage the reservation process and collect the reservation fee on our behalf. Those parties are identified on the reservation page, and in the terms and conditions you agree to when making the reservation. We encourage you to review those terms carefully. Sunflower Labs only obtains the last four digits of the credit card used to pay the reservation fee, which we will retain in association with the information you provide to us. We will learn from the third-party payment processors whether you have paid your reservation fee. We use information obtained from your computing device(s) such as IP addresses, the type of browser and device you use, the webpage that referred you to our site, and identifiers associated with your devices, as well as information obtained from cookies, tracking pixels and similar technologies, when you visit our web site. This information enables us to understand the performance of our website. This information does not include anything which would allow us to associate your computing device or your visit to our website to you, personally.
Using Information
We will use your personal information to identify you in our systems, and to communicate with you. We may contact you via email to provide updates regarding our production process, the timing of our product availability and the opportunity to purchase our products, to inform you of developments relating to our products, and otherwise provide information we need to manage our sales process and inform you of information we feel may be of interest to you. We will use the last four digits of your credit card to allow us to confirm your reservation fee has been paid. You consent to our using the then-current address(es) you have provided in order to deliver communications to you. However, you may elect to opt-out of marketing-related emails by following the directions included within such emails.
Retaining Information
We retain the information we obtain on computers owned and/or operated by us and in third-party data centers in the United States. These computers use industry standard security. We retain your information for only as long as we consider it necessary and relevant for our operations. If you cancel your reservation and submit a request to us by email to support@sunflower-labs.com, we will delete your personal information as soon as reasonably possible. If you registered for a user account, you request the deletion of the user account and all associated information by visiting this page: Delete User Account. Under certain circumstances we may retain information, including personal information, to prevent fraud, collect any fees owed, resolve disputes, troubleshoot problems, assist with any investigation, comply with applicable legal data retention obligations and take other actions permitted by law. After it is no longer necessary for us to retain your personal information, we will dispose of it in a secure manner according to our data retention and deletion policies in effect at that time.
Disclosing Information
We exist to provide products and a valuable service to you. We will not sell or rent your personal information to third parties for their marketing purposes. The circumstances in which we disclose personal information are limited to the following:
- we have your explicit consent to share the information; we need to share your information with service providers under confidentiality restrictions who process data on our behalf in order to operate our business, process your payment transactions, fulfill your product orders, and help us communicate with you as described elsewhere in this Privacy Policy;
- we believe it is necessary to investigate potential violations of our Commercial Terms, or where we believe it is necessary to investigate, prevent or take action regarding illegal activities, suspected fraud or potential threats against persons, property or the systems on which we operate our business;
- we determine that the access, preservation or disclosure of information is required or permitted by law to protect the rights, property or personal safety of Sunflower Labs, or is required to comply with applicable laws, including compliance with warrants, court orders, subpoenas, legal process, or other lawful government requests (including in response to public authorities to meet national security or law enforcement requirements); and
- we do so in connection with the sale or reorganization of all or part of our business, as permitted by applicable law.
Some third parties’ embedded content or plugins on our web site, such as Facebook “Like” buttons, may allow their operators to learn that you have visited our website, and they may combine this information with other, identifiable information they have collected about your visits to other websites or online services.
In each of these circumstances, we will try to minimize the amount of personal information we share to what is directly relevant and necessary to accomplish the specified purpose. As stated above, we do not disclose your personal information to third parties for their marketing purposes without your explicit consent.
While we use contractual and other measures to ensure protection of personal information, the laws and regulations relating to privacy and personal information protection in other jurisdictions may not be the same as, or similar to, your local privacy laws. The governments, courts, law enforcement or regulatory agencies in these other jurisdictions may be able to request disclosure of personal information through the laws of these countries. In an effort to respect your privacy, we will not otherwise disclose your personal information to law enforcement, other government officials, or other third parties without a subpoena, court order or substantially similar legal procedure, except when we believe in good faith that the disclosure of information is necessary to prevent imminent physical harm, financial loss or to report potentially illegal or fraudulent activity.
Securing Your Information
We are committed to protecting the security of your information and take reasonable precautions to protect it. We use industry standard encryption to protect your data in transit. This is commonly referred to as transport layer security (“TLS”) or secure socket layer (“SSL”) technology. However, internet data transmissions cannot be guaranteed to be 100% secure, and we cannot ensure the security of information during its transmission between you and us. Accordingly, you acknowledge that when you transport such information, you do so at your own risk.
We protect your information in our systems using technical and administrative security measures to reduce the risks of loss, misuse, unauthorized access, disclosure and alteration. Some of the safeguards we use are firewalls and data encryption, physical access controls to our data centers, and information access authorization controls.
If we learn of a system breach, we may attempt to notify you and provide information on protective steps, if available, through the email address that you have provided to us or by posting a notice on our web site and/or other communication platforms. Depending on where you live, you may have a legal right to receive such notices in writing.
Information from Children
We do not knowingly collect personal information from children without parental consent. If we learn that we have inadvertently obtained information in violation of applicable laws prohibiting collection of information from children without such consent, we will promptly delete it.
Third Party Privacy Practices
This Privacy Policy addresses only the use and disclosure of information we collect. When you disclose your information to others, such as the third-party services we use to process your reservation and fee, their privacy policies and practices will apply. For example, when you make your reservation using Tilt, Tilt' Privacy Policy governs those communications. We cannot guarantee the privacy or security of your information once you provide it to a third party and we encourage you to evaluate the privacy and security policies of any third party before entering into a transaction and choosing to share your information.
Scope of Policy
This Privacy Policy describes your privacy rights when you elect to visit our web site or reserve our products, and by visiting our site or reserving your opportunity to purchase our products, you accept the substance and application of these terms and policies, and consent to our collection, use, disclosure and retention of your personal information as described in this Privacy Policy. The terms of this Privacy Policy are incorporated by reference in the Commercial Terms that you accept when you make a reservation. Sunflower Labs Inc. is the data controller, and we may store and process your personal information on our computers in the US and elsewhere in the world where our data centers are located.
Changes to Policy
A variety of factors may require changes to this Privacy Policy, including our movement to accepting orders and shipping our Sunflower Smart Lights and Hubs, and changes in laws applicable to us. We will publish an announcement and effective date of any change, along with a description of any material change, and may elect in some cases to send you a message alerting you to the change. If you disagree with any changes and do not wish your information to be subject to a revised Privacy Policy, you will need to cancel any reservation you have made.
