This Privacy Policy (“Policy”) describes how Sunflower Labs Inc. (“Sunflower Labs,” “we,” “us,” “our”) collects, uses, and discloses information from or about you when you visit or use our website at sunflower-labs.com (the “Site”), use our mobile application, or any other Sunflower Labs site or application that links to this Policy; purchase or lease our products or services; or engage in a commercial trial of our products or services (collectively, the "Services").  By browsing the Site or using the Services, you agree to allow us to collect and process information as described in this Privacy Policy.  If you do not agree to this Policy, please do not use the Site or Services.

For purposes of data protection laws, Sunflower Labs is the data controller of your information.

  1. Information We Collect on Behalf of Our Customers

We may process your personal information when your or one of our customers uses our Services.  For example, the drones in the Beehive System (“System”) may capture photos and videos of you.  In some cases, the photos and videos will be stored and processed on the customer’s computer systems, or locally on the System, in addition to the processing and storage in the systems we use to operate the Services. 

Where Sunflower Labs processes this information, our processing is at the direction of our customers and subject to our agreements with those customers. If you have a question about how this information is processed, please contact the customer.

  1. Information We Collect

We obtain information about you through the means discussed below when we provide the Services. Please note that we need certain types of information to provide the Services to you. If you do not provide us with such information, or if you ask us to delete that information, you may no longer be able to access or use the Services (or parts thereof).

Information You Provide to Us
We may collect information you provide to us when you interact with us (e.g., when you request information from us, interact with our personnel, create or modify an account with us, purchase or lease our products, configure and operate a System, or provide us feedback).   

Information you may provide us includes your name, your organization name, phone number, address, and payment and billing information, including payment card details, and any other information you choose to provide us. 

When you configure a System, you will also provide us with your property location and borders, visual images of the property, information about other individuals who will have access to the System, and other details that may be necessary to install and operate the System. We use this information to provide the Services to you and to monitor and improve our Services.

Information We Collect Automatically
We may automatically collect information about your use of the Services as follows:

Device/Usage Information. We may collect and analyze information obtained in connection with your accessing our Site, including but not limited to (a) browser type; (b) ISP or operating system; (c) domain name; (d) access time; (e) referring or exit pages; (f) page views; (g) IP address;; and (h) the type of device that you use. We also track the use of our System, including the frequency and manner in which the System is active and drone deployed, the access to and maintenance and other actions affecting the System hardware, and how you engage with or navigate our Site and mobile application. We use this information (including the information collected by our third-party service providers) to provide support to our customers and for analytics (including to evaluate flight operations and data use) and as otherwise described in this Policy.

Cookies and Other Electronic Technologies. We and our third-party service providers may use cookies, clear GIFs, pixel tags, SDKs, and other technologies that help us better understand user behavior, personalize preferences, perform research and analytics, and improve the Services. These technologies, for example, may allow us to tailor the Services to your needs, save your password in password-protected areas, track the pages you visit, help us manage content, and compile statistics about usage of our Services. We or our third-party service providers also may use certain of these technologies in emails to our customers to help us track email response rates, identify when our emails are viewed, and track whether our emails are forwarded.

You can choose to accept or decline cookies. Most web browsers automatically accept cookies, but your browser may allow you to modify your browser settings to decline cookies if you prefer. If you disable cookies, you may be prevented from taking full advantage of the Services, because the Services may not function properly. As we adopt additional technologies, we may also gather additional information through other methods.

Location. We collect and utilize location data associated with the installation and operation of the System. In some other cases, we collect and store information about where you are located when accessing our Site or otherwise interacting with us, such as by converting your IP address into a rough geolocation.

Deidentified System Performance Data.  We will collect deidentified performance data and flight logs of a System for the purpose of assessing the condition of the System and performing analyses of performance and incidents.

Information from Third-Party Sources
We may receive information about you from publicly and commercially available sources, as permitted by law, which we may combine with other information we receive from or about you.

  1. How We Use Your Information

We may use your information for any of the following purposes:

  • For the purposes for which you provide it;

  • To enable you to use the System and other Services;

  • To communicate with you;

  • For customer support and to respond to your inquiries;

  • For internal recordkeeping purposes;

  • To maintain and improve the Services, and for product development;

  • To address fraud or safety concerns, or to investigate complaints or suspected fraud or wrongdoing;

  • To provide you with a personalized experience on the Services;

  • To perform market research, including, but not limited to, the customization of the Services according to your interests;

  • To provide security and monitoring, and address technical issues and bugs;

  • For other research and analytical purposes;

  • To protect, enforce, or defend the legal rights, privacy, safety, security, or property of Sunflower Labs, its employees or agents, or other users, and to comply with applicable law, including valid legal process such as subpoenas, court orders, or warrants; and

  • For any other purpose, with your consent.

We may combine information that we collect from you through the Services with information that we obtain from affiliated and non-affiliated third parties, and information derived from any other products or services we provide.

We may aggregate and/or de-identify information collected through the Services. We may use de-identified or aggregated data for any purpose, including research and marketing purposes and may also share such data with third parties.

  1. Legal Bases for Use of Your Information

The laws in some jurisdictions require companies to tell you about the legal grounds they rely on to process your information. To the extent those laws apply, our legal bases are as follows:

  • To honor our contractual commitments to you: Where use of your information is necessary to perform our obligations under a contract or commitment to you; for example, to provide the Services you’ve requested from us, or to comply with our Terms or our other legal agreements with you.

  • Legitimate interests: Where use of your information furthers our legitimate interests or the legitimate interests of others. For example, to provide security for our Services, operate our business and our Services, make and receive payments, defend our legal rights, and prevent fraud.

  • Legal compliance: Where we use your information to comply with applicable legal obligations. For example, keeping track of payments for tax and auditing purposes.

  • Consent: Where you have consented to our processing of your information for a particular purpose.

  1. How We Share Your Information

We may share your information with the following entities (for which our practices may vary depending on the type of information):

  • Affiliates, Subsidiaries, and Partners. We may share information with our affiliates and subsidiaries, as well as select business partners.

  • Service Providers. We may share information with third parties that help us operate our business and provide our Services, such as contractors that provide us with technology, services, data, data storage, or content.

  • Other Parties When Required by Law or as Necessary to Protect Our Users and Services. We may share information when we believe that doing so is necessary to protect, enforce, or defend the legal rights, privacy, safety, or property of Sunflower Labs, our personnel or agents or users, and to comply with applicable laws. In other instances, we may share your information with law enforcement or other government entities in order to comply with valid legal process, including responding to requests from public and government authorities.

  • Business Transfers. We may transfer the information we hold in the event we sell or transfer all or a portion of our business or assets (such as in connection with a merger, acquisition, reorganization, dissolution or liquidation) or take steps in anticipation of such a transaction.

  • Aggregated or De-Identified Information. We may share aggregated or de-identified data with any entities for any purpose, in our discretion.

  • Otherwise with Your Consent or at Your Direction. In addition to the sharing described in this Policy, we may share information about you with third parties whenever you consent to or direct such sharing.

  1. Retaining Information

We retain your information for as long as necessary to provide products and Services you have requested, for as long as you are a customer or commercial trial partner, as long as necessary for our legitimate business interests, and/or as long as required to comply with any applicable legal obligations.

  1. Online Analytics

We may use third-party analytics services, and these services may use the information described in this Policy to help us analyze how users use the Services, or maintain or improve the Services.

  1. Securing Your Information

We use a combination of physical, technical, and organizational security measures designed to protect your information against accidental or unlawful destruction or accidental loss, alteration, unauthorized disclosure, or access. However, no data transmission or method of electronic storage can be guaranteed to be 100% secure, and we cannot ensure the security of information during its transmission between you and us.

You play a critical role in protecting your information by maintaining up-to-date computer security protections. Steps you take to ensure the security of your computer, computer passwords, or other personal identifier authentication mechanisms are key components of the protection of your personal information. You agree that you are responsible for any additional verification procedures and security you deem necessary. 

  1. Data Retention

We will retain your information for as long as necessary to provide the Services and for the other purposes set out in this Policy. We also store information when necessary to comply with contractual and legal obligations, when we have a legitimate interest to do so (such as providing, improving and developing the Services, and enhancing the safety, security, and stability of the Services).  We may also store your information in order to defend or ascertain our legal rights, respond to valid legal requests, in the context of a merger/acquisition, or in order to implement our Terms or our other legal agreements with you. 

In all cases, in addition to the purposes, we consider the amount, nature, and sensitivity of the personal data, as well as the potential risk of harm from unauthorized use or disclosure of your personal data, in determining how long to retain personal data. 

  1. Third-Party Links and Services

The Services may contain links to, or embedded content or plugins from, third-party websites or services. If you choose to use these sites or services, you may disclose your information not just to those third parties, but also to their users, business partners, and other parties (depending on how their product or services function). Because these third-party websites and services are not operated by Sunflower Labs, we are not responsible for the content or practices of those websites or services. The collection, use, and disclosure of your personal and other information will be subject to the privacy policies of the third-party websites or services, and not this Policy. We urge you to read the privacy and security policies of these third parties.

  1. Children’s Privacy

The Services are not intended for children under age 13, and we do not knowingly collect personal information from children under 13 without parental consent. If we learn that a child under the age of 13 has provided us with personal information (as defined in the Children’s Online Privacy Protection Act), we will delete it in accordance with applicable law.

  1. International Users and Consent to Transfer

Your information may be processed by us in the United States, where data protection and privacy regulations may not offer the same level of protection as in other parts of the world, such as the European Union. By using the Services, you understand and agree to the transfer of your information to the United States, where it may be accessible to law enforcement and national security authorities.

Where required, we will use appropriate safeguards for transferring data outside of the European Union.  This includes signing Standard Contractual Clauses that govern the transfers of such data.  For more information about these transfer mechanisms, please contact us as detailed in the “Contact Information” section below.

  1. Shine the Light Disclosure

California's "Shine the Light" law, Cal. Civil Code section 1798.83, requires certain businesses to respond to California customers’ inquiries about the categories of personal information (as defined in that statute) that are shared for third parties' direct marketing purposes over the prior calendar year. We do not share your personal information with third parties for their own direct marketing purposes.

  1. Your Choices & Rights

You have certain choices with respect to your information, such as:

  • Account Information: If you registered for a user account, you can update certain of your account information by accessing your account. You can also request the deletion of the user account and all associated information by visiting this page: Delete User Account.  Please note if your account was created as part of our contract with your organization, you will need to contact the organization to request deletion of your account or make certain changes to it.

  • Marketing Emails: You can unsubscribe from marketing emails by following the directions in those emails. If you unsubscribe from marketing emails, please be advised you will continue to receive certain email communications related to your account including information regarding transactions and your relationship with Sunflower Labs.

  • Cookies & Analytics: You can opt out of certain cookie-related and analytics processing by following the instructions in this Privacy Policy.

The laws of your jurisdiction may also permit you to request that we:

  • provide access to and/or a copy of certain information we hold about you;

  • prevent the processing of your information for direct marketing purposes;

  • update information which is out of date or incorrect;

  • delete certain information that we are holding about you;

  • restrict the way that we process and disclose certain of your information;

  • transfer your information to a third-party provider of products or services; and

  • revoke your consent for the processing of your information.

Certain information may be exempt from such requests in some circumstances, which may include our need to continue processing your information for our legitimate interests or to comply with a legal obligation. We may request you provide us with information necessary to confirm your identity before responding to your request.

In addition to those rights, you have the right to lodge a complaint with the relevant supervisory authority. However, we encourage you to contact us first, and we will do our best to resolve your concern.

Please note that if we process your information as part of our contract with your organization, you will need to submit your request or complaint to that organization. 

  1. Changes to This Policy

We may make changes to this Policy from time to time. These changes will be reflected in the most current Policy, which is available through the Services. If we make a material change to this Policy, we will notify you as required by law. Your continued use of the Services following any change signifies your acceptance of our Policy as modified.
